1. About these terms
These terms govern your use of webworxlabs.com and anything we make available through it, including our research reports. By using the site or requesting a report, you agree to them. If you do not agree, please do not use the site.
Web Worx Labs is a marketing agency serving regulated industries, with its registered office at 30 Eglinton Ave W, Suite 401, Mississauga, Ontario L5R 3E7, Canada. In these terms, “we”, “us” and “our” mean Web Worx Labs, and “you” means the person or organisation using the site.
2. Nothing here is professional advice
This is the most important section of these terms, so we have put it near the top.
Our research, articles and reports are published for general information. They are not investment advice, financial advice, legal advice, tax advice or accounting advice, and you should not treat them as such. Nothing we publish is a recommendation to buy, sell or hold any security or to participate in any offering.
Nothing on this site is an offer to sell, or a solicitation of an offer to buy, any security. We do not offer securities, we do not introduce investors to offerings, and we do not participate in the sale of securities.
We are not a broker dealer, placement agent, finder, investment adviser, exempt market dealer or registrant of any kind, and we are not registered as any of those with the United States Securities and Exchange Commission, FINRA, any Canadian securities commission or any other regulator. We provide marketing services. Our clients remain solely responsible for their own regulatory compliance, including compliance with Regulation D and all securities laws applying to them.
Before acting on anything you read here, take advice from a qualified professional who knows your circumstances.
3. Our research and how you may use it
You may read, download, print and share our reports in their entirety, internally within your organisation or with colleagues and contacts, at no cost.
You may quote from them publicly provided you attribute the material to Web Worx Labs and do not alter the meaning of what you quote.
You may not:
- Sell, licence or charge for access to our reports
- Republish a report in full as though it were your own work, or remove our name from it
- Present our data as your own original research
- Alter figures, charts or findings and continue to attribute them to us
- Use our reports or data to train a machine learning model without our written permission
- Scrape, harvest or systematically extract content from this site by automated means
4. Where our data comes from, and its limits
Our research is built from public filings and other publicly available sources, together with our own review and analysis. We take care over it, but we make no warranty that it is complete, accurate or current.
Figures are correct as at the date of publication and are not updated afterwards. Public filings are self reported by the filer and may themselves contain errors. Our classification of a firm into a category reflects our judgement, and reasonable people could classify differently.
Naming a firm in our research is neither an endorsement nor a criticism of it. We have no relationship with the firms in our data unless we say otherwise, and their inclusion does not imply they participated, reviewed the work or agree with it.
If you believe something attributed to your firm is wrong, write to us at info@webworxlabs.com and we will look at it and correct it in the next edition where warranted.
5. Using the site
You agree to use the site lawfully, and not to:
- Interfere with the site, its security or its availability
- Attempt to gain unauthorised access to any part of it or any connected system
- Submit false, misleading or impersonated details through our forms
- Use our forms or chat to send unsolicited advertising or spam
- Introduce malicious code, or place excessive automated load on the site
We may refuse, screen or remove submissions, and may restrict access to the site, at our discretion.
6. Information you send us
You are responsible for the accuracy of information you give us and for having the right to give it. How we handle personal information is set out in our Privacy PolicyTerms of Use, which forms part of these terms.
If you send us an idea, suggestion or feedback, we may use it without restriction and without owing you payment or attribution. Please do not send us confidential information through this site.
7. Intellectual property
The site, our reports, and the text, charts, design and branding in them are owned by us or our licensors and are protected by copyright and other rights. Except for the permissions in section 3, no rights are granted to you.
The names and marks of other organisations mentioned in our research belong to their owners and are used for identification only.
8. Third party sites and services
We link to websites and services we do not control. We are not responsible for their content, their availability or their practices, and a link is not an endorsement.
9. Availability
We aim to keep the site available but we do not guarantee it. We may change, suspend or withdraw any part of the site or any report at any time, without notice.
10. No warranties
The site and our reports are provided as is and as available. To the fullest extent the law allows, we exclude all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy and non infringement.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, business, goodwill, data or anticipated savings, arising out of your use of the site or reliance on anything we publish, whether the claim is in contract, tort, negligence or otherwise, and whether or not we were advised such loss was possible.
Where liability cannot lawfully be excluded, our total liability arising out of or relating to the site and our published research is limited to one hundred Canadian dollars.
This section does not limit liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, or for anything else that cannot be limited under applicable law. Nothing in these terms affects consumer rights that cannot be waived.
These limits apply to our free published research and to your use of this website. They do not govern paid client engagements, which are covered by the separate agreement signed for that work.
12. Indemnity
You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these terms or your misuse of the site or our research.
13. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction, and you agree to that venue. If you are a consumer, this does not deprive you of the protection of mandatory laws in your own country.
14. Changes to these terms
We may update these terms. The version published on this page at the time you use the site is the one that applies. We will change the last updated date when we revise them.
15. General
If any part of these terms is held unenforceable, the rest continues to apply. Our failure to enforce a provision is not a waiver of it. These terms, together with our Privacy Policy, are the entire agreement between us in relation to your use of this site.
